Yes, it's the fine print. We kept it readable. These Terms are the ground rules for using imhotandfabulous.com and buying from us.

1. Who we are

imhotandfabulous.com is operated by IMHOTAF LLC, a Florida limited liability company doing business as I'm Hot and Fabulous ("we," "us," "our"). Email us at info@imhotandfabulous.com.

Some international orders are sold to you by Global-e US Inc. ("Global-e"), our checkout partner and merchant of record. If yours is, Global-e's Terms of Sale apply to that purchase along with these Terms, and the charge on your card statement will usually show Global-e. Not sure who sold your order? Email us and we'll check.

2. Agreeing to these Terms

By using this site or placing an order, you agree to these Terms and to the policies they link to: our Shipping Policy, Refund Policy and Privacy Policy. Custom and personalized orders, and wholesale or bulk orders whose quote says so, are also covered by our Custom Order Terms, which apply to those orders where they differ from these Terms. If you don't agree, please don't use the site.

3. Our products

We describe every fan as accurately as we can, including its size, materials and finish. Colors can look different from screen to screen, printed fabric and natural wood vary slightly from piece to piece, and sparkle and holographic finishes shift in the light. Those variations are part of the product, not defects.

Our fans are general use products designed for people 13 and older. They are not designed or intended primarily for children 12 and under, and they are not toys.

4. Prices and orders

Prices are shown on the site and can change at any time. Placing an order is an offer to buy. The order confirmation email you get right after checkout means we've received your order. We accept it when we ship it. We may limit quantities, and we may refuse or cancel an order, in whole or in part, if an item is out of stock, if a price or product detail was listed in error, or if we suspect fraud. If we cancel after you've paid, we refund you in full within 7 business days.

We fulfill orders within the time in our Shipping Policy, meaning we pack your order and hand it to the carrier. If we can't fulfill your order on time, we'll email you a new date and the choice to accept it or cancel. If you cancel, we refund you in full within 7 business days.

5. Payment and taxes

Orders placed at checkout are paid in full there, using the payment methods shown. Orders under our Custom Order Terms are paid by invoice. Our US prices don't include sales tax. Where we're required to collect it, sales tax is calculated at checkout, added to your order and shown separately on your receipt. Buying for resale with delivery in Florida? Send us your Florida Annual Resale Certificate before you pay, or Florida sales tax will be charged. For international orders, duties and import taxes are included in your checkout total. Depending on your country, the prices you see may already include tax.

6. Shipping

Processing times, delivery estimates, lost packages, and duties on international orders are covered in our Shipping Policy. Orders covered by our Custom Order Terms follow the shipping rules in those terms instead. Delivery times after an order ships are estimates, not guarantees.

7. Returns and refunds

Returns, exchanges and refunds are covered in our Refund Policy. Orders covered by our Custom Order Terms follow the cancellation, return and refund rules in those terms instead.

8. Our name, designs and content

The I'm Hot and Fabulous name and logo, our fan designs, photos, videos and written content, and the look of this site are owned by or licensed to IMHOTAF LLC, and are protected by applicable intellectual property laws.

Buying a fan gets you the fan, not the right to copy it. Unless we've given you written permission, please don't:

  • copy or reproduce our designs, photos or product descriptions, or sell copies of them;
  • use the I'm Hot and Fabulous name or logo in a way that suggests we sponsor, endorse or partner with you;
  • use our name or logo in ads, domain names, product listings or social media handles.

You're welcome to link to our site and to share our posts using each platform's own sharing features.

9. Intellectual property concerns

We respect other people's intellectual property and expect the same in return. If you believe something on our site or one of our products infringes your copyright, trademark or design rights, email info@imhotandfabulous.com with:

  • your name and contact details, and who you represent if you're acting for someone else;
  • the specific product or page involved, with a link;
  • the right you're relying on, including any registration number, the country or region where it's registered, and the registration date;
  • a statement that you believe in good faith the use isn't authorized and that the information in your notice is accurate.

We review every complete notice and respond. A notice missing this information may take longer to review.

10. Reviews and social posts

When you post a review, photo or other content on our site, you confirm it's yours to share and reflects your own honest experience. You give IMHOTAF LLC a non-exclusive, royalty-free, worldwide license to display, reproduce and share it on our site, in our emails and on our social channels, together with the name you submitted it under.

We remove a review only if it's fake or clearly false, unrelated to our products, defamatory, harassing, abusive, obscene or discriminatory, infringes someone else's rights, or shares confidential or personal information. These rules apply equally to positive and negative reviews.

When you tag us on social media, we may reshare your post to our Stories using the platform's own sharing tools, with credit to you. Ask and we'll take it down. Before we repost your photo anywhere else, including our feed, ads or website, we'll ask for your permission.

11. Using the site

Please don't misuse the site. That means no scraping or bulk copying of listings or images, no attempts to break into, overload or disrupt it, and no using it for anything unlawful. Links to other websites are provided for convenience, and we're not responsible for their content or policies.

12. Disclaimers

To the extent the law allows, the site is provided "as is" and "as available." We work to keep it accurate and running, but we don't promise it will always be error-free or uninterrupted. This doesn't affect any warranty or guarantee the law gives you that can't be excluded.

13. Limitation of liability

To the extent the law allows, IMHOTAF LLC is not liable for indirect, incidental, special or consequential losses, such as lost profits or event costs, arising from your use of the site or our products. Our total liability for any claim relating to an order is limited to the amount you paid for that order. These limits don't apply to personal injury or property damage caused by our products, or to losses caused by our fraud, gross negligence or willful misconduct. Nothing in these Terms limits liability that can't legally be limited, or any rights you have as a consumer under the laws where you live.

14. Governing law and disputes

These Terms are governed by the laws of the State of Florida, without regard to its conflict of law rules. If something goes wrong, please email us first. Most problems get fixed quickly that way. Any lawsuit about these Terms or an order must be brought only in the state courts located in Martin County, Florida, or the federal courts for the Southern District of Florida, except that either of us may bring an individual claim in small claims court. This doesn't take away any right the law where you live gives you to bring a claim in your local courts.

15. Changes to these Terms

We may update these Terms from time to time. The "Last updated" date at the top shows the current version. Changes apply to orders placed after they're posted, not to orders already placed.
