Custom Order Terms

Custom fans are made for your moment, so they come with a few extra ground rules. These terms apply to custom and personalized orders, and to wholesale or bulk orders when your quote says so, placed with IMHOTAF LLC, doing business as I'm Hot and Fabulous. In these terms, "custom order" means any of these orders. If your order doesn't need a proof, the proof steps below don't apply, and your quote tells you how it ships.

These terms sit alongside our Terms of Service. Where the two differ, these terms apply to your order. The version of these terms posted when you pay your invoice applies to your order. If you send us a purchase order or other form, its terms don't change these terms unless we agree in writing. Paying your invoice means you accept these terms, so please read them before you pay.

1. Quotes

  • Custom orders start at 30 fans per design, so two designs means 30 of each. If you'd like small differences between fans, such as individual names, ask us first whether they count as separate designs.
  • Quotes are valid for 30 days. After that, pricing can change with material and freight costs.
  • Shipping is quoted separately for every order, to your delivery address. Shipping offers shown on our retail store do not apply to custom orders.
  • Your invoice shows any sales tax that applies. If you're buying fans to resell and they're delivered in Florida, send us your Florida Annual Resale Certificate before you pay. Otherwise we have to charge Florida sales tax.

2. Payment and approval

Custom orders are paid in full by invoice before production begins. Your order is accepted, and these terms bind both of us, when you pay your invoice. The line in our Terms of Service about accepting orders when we ship them doesn't apply to custom orders. Your price is fixed once you pay your invoice, apart from any added costs described in these terms. Please approve your proof in writing by replying to our proof email.

3. Your artwork

  • You keep ownership of the logos, photos, names and artwork you send us. You give us permission to use them only to create your proof and to produce and ship your order.
  • By sending artwork, you confirm that you own it or have permission to put it on fans. That includes any logo, brand or team name, character, photo, song lyric or quote, and permission from anyone shown in a photo you send. We don't check trademark or copyright clearance for you.
  • If anyone claims that artwork you supplied infringes their rights, you agree to defend and hold IMHOTAF LLC harmless, and to cover the resulting costs, including reasonable legal fees.
  • We can decline any design that appears to use someone else's intellectual property without permission, or that we consider hateful or harassing. If we decline after you've paid, you get a full refund.
  • We set text in fonts licensed for commercial printing, such as Google Fonts. If you supply a font or ask us to match one, you confirm you have the right to use it.
  • We don't make fans designed or marketed primarily for children 12 and under, such as favors for a young child's birthday party.

4. Our design work

  • The mockups, layouts and templates we create remain ours. The finished fans are yours to use, give away or resell however you like.
  • We won't sell fans carrying your logo, names or artwork to anyone else.
  • We never post a design that shows your logo, brand, names or photos without your permission. We may share custom designs that don't show any of those.

5. Proofs and color

  • Every order with custom artwork gets a free digital proof before production. Two rounds of changes are included. More may add cost and time.
  • Check your proof carefully: spelling, names, dates, colors, layout and quantity. Once you approve it, that is what we produce. Errors in an approved proof are not grounds for a refund or a free reprint.
  • We print colors from Pantone C references. Send yours if you have them, or we'll match the colors in your artwork. Either way, we match as closely as the material allows. Exact matches aren't guaranteed, especially on wood and painted ribs. Natural wood varies in grain and tone from fan to fan. Holographic, sparkle and metallic finishes come in set options and can't be custom color matched.
  • If your order has a proof and you haven't approved it within 60 days of paying, not counting any days you were waiting on a proof or revision from us, we may cancel your order and refund you, less the 8% cancellation fee in section 8.
  • Physical samples are available on request, are quoted separately and add time. If you order one, your ship date counts from your written approval of the sample.

6. Ship date and rush orders

  • We ship within 4 weeks after your payment is received and your proof, if your order has one, is approved, unless your quote gives a later ship date. Our factory closes each year for a holiday, usually from late January to late February. If any part of those 4 weeks falls during the closure, your ship date moves back by the length of the closure plus 1 week, and we'll email you the new date before your 4 weeks start.
  • If we can't ship by that date, we'll email you a new date and your choice: accept it, or cancel for a full refund, which we send within 7 business days.
  • Delivery times after your order ships are estimates. Carriers and customs can add time, so please build in a buffer before your event.
  • Rush production may be available, depending on your date and quantity, and may cost extra. A rush isn't guaranteed until we confirm it by email.

7. Shipping

  • Unless your quote says otherwise, custom orders ship by express courier, which cannot deliver to P.O. boxes. Please give us a street address and a phone number for the recipient.
  • We ship only to the delivery address on your paid invoice. Please email any address change before production starts, and we'll reissue your invoice. After production starts, a change may not be possible and may add cost. Reshipping to a corrected address after your order ships is charged at cost.
  • Your shipping quote covers delivery to your US address. If a carrier asks you to pay any charge on delivery, email us before you pay. If you've already paid a charge your quote covered, send us the receipt and we'll refund it.
  • For deliveries outside the United States, your quote says whether import duties and taxes are included. If they aren't, the recipient pays them on arrival.
  • If your order hasn't arrived within 10 business days after it ships, email us. We'll open a trace with the carrier, and if the carrier confirms a carton is lost, we'll reproduce or refund the missing fans, our choice. If your order arrives in more than one carton, the delivery time limits in section 9 count from delivery of the last carton.
  • We send tracking as soon as your order ships.

8. Cancellations, changes and returns

  • You can cancel by emailing us within 24 hours of paying, as long as production hasn't started. Production starts when we place your order with our factory, after your payment is received and your proof, if your order has one, is approved.
  • If you cancel within those 24 hours, an 8% cancellation fee, our estimate of the payment processing, design, proof and scheduling costs already incurred, is deducted from your refund. It's figured on your order total before shipping and sales tax, and any shipping and sales tax you paid is refunded in full. We send your refund within 7 business days.
  • After 24 hours, and until production starts, you can still cancel by emailing us. A 35% cancellation fee, our estimate of the costs and losses a cancellation at that stage causes, is deducted from your refund. It's figured on your order total before shipping and sales tax, and any shipping and sales tax you paid is refunded in full. We send your refund within 7 business days. Once production has started, you can't cancel your order or get a refund, except as described in sections 3, 5, 6, 7 and 9.
  • Once production has started, changes to artwork, quantity or address may not be possible. Where they are, they may add cost and time.
  • Custom orders are final sale. They can't be returned or exchanged. This doesn't limit section 9.
  • Please email us before disputing a charge. If you dispute one, we'll share your approved proof, invoice and tracking with your bank or payment provider.

9. Damaged, short or defective fans

Our factory ships the exact quantity on your invoice. Please check your order as soon as it arrives.

  • Shipping damage, a short count, or fans that don't match your approved proof: email info@imhotandfabulous.com within 2 business days of delivery with your order number, a count of the affected fans, and clear photos of the fans and the packaging.
  • A defect that shows up in normal use: email us as soon as you notice it, with your order number, a count of the affected fans and photos.

Once we confirm shipping damage, a short count, or fans that don't match your approved proof, we'll replace or refund the affected fans, our choice. If a fan has a defect, we'll make it right as the law requires. The natural variations described in section 5 are not defects.

10. Liability

To the extent the law allows, our total liability for anything relating to a custom order is limited to the amount you paid for that order. We're not liable for indirect or consequential losses, including event, venue, travel or marketing costs, or lost profits. These limits don't apply to personal injury or property damage caused by our products, or to losses caused by our fraud, gross negligence or willful misconduct. Nothing in these terms limits rights you have as a consumer under the laws where you live, including your rights if fans are faulty or not as described.
